Terms and Conditions

By entering into the Competition you agree to the following terms of entry, including any and all Schedules to the terms of entry.

Pacific Climate Warriors, 350.org Ltd (Australia) is a registered charity and registered as a company limited by guarantee.

Entry conditions

  • Entrants must be Australian citizens or residents who are 18 years of age or below.
  • All entrants below 18 years of age, must have the consent of their parent or guardian before entering this competition.
  • Entrants must identify as one or more of the following:
  • Aboriginal
  • Torres Strait Islander
  • South Sea Islander
  • Pacific Islander
  • Maori
  • Entrants must be a primary or high school student.
  • Entrants must be ordinarily resident in Victoria.
  • Entrants must consent to have their full name and photograph published.

Staff members, and immediate family of staff members of the Promoter are ineligible to enter. 

Competition period

  • The competition begins 21 August 2019.
  • Entries into the competition close at 11.59 pm (AEST) on Friday 13 September 2019.

Entry method

To enter the competition, entrants must complete one of the following two entry methods:

1. Online entry

  • Visit the competition page on the 350.org website (https://350.org.au/te-laa-ote-vaka-art-competition/) during the Competition Period.
  • Fully complete the online entry form in the manner required, including a short description of your work, and submit an electronic version of the entrance design.

OR

2. Postal entry

  • Fully complete the printed entry form, including a short description of your work, and include an A3 sized entrance design.

Maximum number of entries

One (1) entry per person during the Competition Period.

Judging details

This Competition is a game of skill. Competition entries will be judged by a panel of judges appointed by the Pacific Climate Warriors, 350.org. The judges will decide winners based on appropriateness to theme, compliance with terms, originality, creativity and boldness after the Competition Period.

Winners

Four (4) winners will be chosen from entrants.  Two (2) winners representing Aboriginal and/or Torres Strait Islander communities, and two (2) winners representing South Pacific Islander, Pacific Islander and/or Maori communities.

Prize details

There is no monetary prize.  The winning designs will be printed on banners which will appear at and lead the student strike for the Global Climate Strike on 20 September 2019.

Notification of winners

Winners will be notified by 5.00pm 16 September 2019 via the telephone number supplied to the Promoter when entering the Competition.

Publication details and claiming of prizes

In accepting the prize, each winner consents to:

  • the Promoter publishing each winner’s full name on the 350.org website ((https://350.org.au/te-laa-ote-vaka-art-competition/) on 17 September 2019; and
  • the use of the winner’s personal information in accordance with the Promoter’s Privacy Policy and the terms of entry.

Terms of entry

  1. These terms must be read together with the Schedule for this Competition. The Schedule defines certain terminology used in these terms. By entering, entrants accept these terms. To the extent of any inconsistency between the Schedule and these terms, the Schedule prevails.
  2. Entry is open only entrants who comply with all entry conditions and entry method.
  3. The Competition will be conducted during the Competition Period.
  4. To enter the Competition, entrants must follow the entry method during the Competition Period.
  5. Entries must be received by the Promoter during the Competition Period. Entrants may submit up to the maximum number of entries.
  6. By entering, the entrant agrees that, without limitation:a)they are responsible for the content of their entry and for ensuring that the entry complies with these Terms and Conditions;
      • a) they are responsible for the content of their entry and for ensuring that the entry complies with these Terms and Conditions;

        b) the content submitted is their own, or they have consent to the use the content for the Competition;

        c) they will not submit material that is unlawful or fraudulent, that is in breach of any intellectual property, privacy, publicity or other rights, defamatory, obscene or derogatory;

        d) they have complied with all applicable laws and regulations, including without limitation, those governing copyright, content, defamation, privacy, publicity and access to or use of others’ computers or communication systems;

        e) they have the full rights to grant to the Promoter the rights referred to in these Terms and Conditions; and

        f) they will indemnify the Promoter against all costs and claims by third parties arising from a breach of these Terms and Conditions.

  7. The Promoter reserves the right, at any time, to verify the validity of entries and entrants (including an entrant’s identity, age and place or residence) and to disqualify an entrant who submits an entry that is not in accordance with these Terms and Conditions.
  8. The decision of Judging Panel in relation to any aspect of the Competition will be final and binding on all entrants.  No correspondence will be entered into.
  9. The Promoter accepts no responsibility for late, lost, incomplete, incorrectly submitted, delayed, illegible, corrupted or misdirected entries, claims or correspondence whether due to error, omission, alteration, tampering, deletion, theft, destruction, transmission interruption, communications failure or otherwise. The Promoter has no control over communications networks or services, the internet, or computer or telephone networks or lines and accepts no responsibility for any problems associated with them, whether due to traffic congestion, technical malfunction or otherwise. The Promoter is not liable for any consequences of user error including (without limitation) costs incurred.
  10. The prize/s are specified in the prize details. The total prize pool is specified in the total prize pool section of the Schedule.
  11. All entries and materials submitted to the Promoter in connection with this Competition (in any form, including without limitation in hard copy or electronic form), remain the intellectual property of the Entrant (Entrant Material).
  12. The Entrant grants to or will obtain for the Promoter a perpetual, irrevocable, royalty-free licence to use, reproduce, modify, adapt, publish, broadcast, exploit, communicate or sub-licence the Entrant Material.   
  13. The Entrant warrants that it can grant the licence set out in above in clause 12 and that the Promoter’s use of the Entrant Material will not infringe any person’s intellectual property or moral rights.
  14. Entrants may, at the Promoter’s request, and with the consent of their parent or guardian, participate in promotional activity (such as publicity and photography) surrounding this Competition or the winning of any prize, free of charge, and they consent to the Promoter and its related bodies corporate using their name and image in promotional material. If the entrant’s parent or guardian consents to their participation in promotional activities, they also consent to the entrant being broadcast, filmed, photographed or otherwise recorded without compensation while participating in this Competition, or in taking or using any prize, and they consent to the Promoter repeating any such broadcast, film or other recording at any time.
  15. The winner/s will be notified as stated in the notification of winners section of the Schedule and their name and state of residence will be published in accordance with the publication details.
  16. The Promoter and its associated agencies and companies will not be liable for any loss (including, without limitation, indirect, special or consequential loss or loss of profits), expense, damage, personal injury or death which is suffered or sustained (whether or not arising from any person’s negligence) in connection with this Competition or accepting or using any prize, except for any liability which cannot be excluded by law (in which case that liability is limited to the minimum allowable by law).
  17. Without limiting any other paragraph, the Promoter may at its discretion amend any aspect of this Competition or of these terms, subject to applicable laws and subject to the approval of the relevant authorities in each relevant State, if required.
  18. The information entrants provide will be used by the Promoter for the purpose of conducting this Competition. By entering this Competition, entrants consent to the storage of their personal information on the databases of the Promoter and its related bodies corporate. The Promoter may disclose entrants’ personal information to its contractors and agents to assist in conducting this Competition or communicating with entrants. The Promoter is bound by the Australian Privacy Principles in the Privacy Act 1988. Entrants can view the 350.org Privacy Policy at https://350.org/privacy/.
  19. These terms of entry are governed by the laws of Victoria.
